Gearbox CEO Randy Pitchford and ex-lawyer locked in nasty legal battle over $12 million ‘secret bonus’ and ‘underage pornography’

Gearbox CEO Randy Pitchford and the company’s former general counsel Wade Callender are suing each other in a nasty legal battle, with both sides making extreme fraudulent claims.
The game developer, known for creating the Borderlands franchise, previously filed a lawsuit against Callender back in November last year – claiming he borrowed money from Gearbox for tuition and a home loan which he failed to pay back.
They also claimed Callender ‘abused the privilege of credit card access’ by charging a number of personal expenses on their account.

Callender, who acted as Gearbox’s lawyer between 2010 to 2018, filed a lawsuit a month later on 21 December 2018 (via Kotaku ), which claims Pitchford violated numerous terms in his contract.
In his lawsuit, Callender alleges Pitchford received a ‘personal, secretive “Executive Bonus”’ from publisher Take-Two of $12 million (£9.3 million), which was paid against employee royalties.
His most disturbing allegation involves a USB drive Pitchford is claimed to have left in a Texas restaurant containing sensitive corporate documents, along with, as the lawsuit states: ‘Randy Pitchford’s personal collection of “underage” pornography.’
In an unearthed 2014 interview on the Piff Podcast (via Ars Technica ), Pitchford acknowledged there was porn on the USB drive, clarifying it wasn’t ‘underage’, but ‘barely legal’ pornography – which he misplaced on the drive at the Medieval Times restaurant in Dallas.

Speaking on the podcast, Pitchford said: ‘Some kid, an employee of Medieval Times, discovered this memory stick, took it home… and discovered secrets of my company and future games in development, and also discovered the pornography. It was “barely legal” porn. The girl’s handle was “Only 18”.’
He claimed he copied the pornographic video onto the USB drive in order to emulate a magic trick used in the clip, explaining how the USB was returned while he was away on a business trip, with many of Gearbox staff wondering why the video was on here.
‘I think the entire office looked at it,’ Pitchford said. ‘And there was one piece of content on here. And it never occurred to any of them that the reason why there was just that single porno was because of the magic trick, not because of… I don’t know what the fuck they thought.’
In light of Callender’s lawsuit, Pitchford has since responded on Twitter, writing: ‘The attacks made by my former friend and colleague have no basis in reality or law.
‘He is simply trying to shake me down for money. We will win, but because lawsuits are pending I can’t comment as much as I’d like. I am shocked by his lies.’

He added: ‘As a father, I find crimes against children to be especially repugnant. It is very painful that a former friend and colleague would lie to try to associate me with such vile behaviour in his own greedy pursuit of money.’
Gearbox also released a statement to Kotaku branding the allegations as ‘absurd’, saying how they ‘look forward to addressing this meritless lawsuit in court’.
